Terms of Service

These terms govern the free use of the MandelKit website, public Region Gallery, and related web services.

1. Provider and scope

The provider is Björn Kindler, Kindler Dev, Bischofshofener Str. 9, 82008 Unterhaching, Germany. Additional contact information is available in the Legal Notice. The terms incorporated when acquiring MandelKit through the App Store also apply to the purchase and use of the app. Mandatory statutory rights remain unaffected.

2. Service and availability

MandelKit provides information about the app, a public gallery of voluntarily published fractal regions, and functions for opening, rating, and reporting those regions. The service may be adapted or temporarily restricted for security, maintenance, or development. Continuous availability is not guaranteed.

3. Publishing your regions

A region is published only when you explicitly choose the publishing command in MandelKit. You may publish only content for which you hold the necessary rights. Prohibited content includes unlawful, infringing, deceptive, discriminatory, threatening, violence-glorifying or pornographic material, spam, malware, personal data of third parties without a legal basis, and names containing web links, contact details, markup, hidden control characters, or typical spam patterns.

4. Rights needed to operate the gallery

For the duration of publication, you grant the provider a non-exclusive, worldwide, royalty-free right to store, technically adapt, and make the submitted region data, name, and preview publicly available solely to operate the gallery and to display link or social-media previews. You may withdraw publication in MandelKit at any time. This use then ends; technically necessary deletion periods and backups are described in the Privacy Policy.

5. Moderation, reports, and review

Automated checks may reject prohibited names, excessive requests, and typical abuse patterns. Several independent reports may place a region into preliminary, reversible quarantine. Reported or otherwise suspicious content may be restricted or removed after human review. Measures are applied diligently, objectively, and proportionately. You may request review or complain at info@kindler-dev.de. Where required by law, reasons are provided for a moderation decision.

6. Ratings

Heart ratings are intended to provide a fair community ranking. Technical safeguards limit simple duplicate ratings. Manipulation, automated bulk requests, and attempts to bypass safeguards are prohibited.

7. Social-media integration

TikTok and other social-media interfaces are currently used solely by the provider to publish official MandelKit content to its brand channels. The website currently offers no TikTok sign-in and no facility for users to connect their own TikTok accounts.

8. Liability

Statutory liability rules apply. Liability remains unlimited for intent, gross negligence, injury to life, body or health, and under mandatory statutory provisions. For a slightly negligent breach of an essential contractual duty, liability is limited to foreseeable damage typical of the contract.

9. Changes to these terms

Material changes will be announced clearly and in reasonable time on this page. Changes apply only for the future. If you disagree with a change, you may stop using the service and withdraw regions you previously published.

10. Governing law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections of the country in which you habitually reside remain unaffected. The provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Legal framework

The rules on incorporation and transparency reflect Sections 305(2) and 307(1) of the German Civil Code (BGB). The moderation description reflects Articles 14(1)–(4), 16, and 17 of Regulation (EU) 2022/2065 (DSA). Legal-source date: August 8, 2026.
